DJ SERVICE AGREEMENT

1. Scope of Services
The DJ agrees to provide music and entertainment services for the Client’s event as follows:

● Event End Time: [End Time]

2. Payment Terms
● Total Fee: $[Amount]
● Booking Retainer: A non-refundable retainer of no less than 30% of the total bill is due upon three days of signing this Agreement to allow us to remove the date from our calendar as well as marking equipment as reserved and any customization for your event will have started.
● Final Payment: The remaining balance is due 7 days prior to the event or on the event date before any setup begins.
● Overtime Rate: If the event exceeds the agreed-upon end time, overtime will be charged at a per hour rate listed on the invoice, payable at the conclusion of the event.
3. Cancellation Policy
● Client Cancellation: If the Client cancels the event more than [30/60/90] days prior to the event date, no additional payment is due. If the cancellation occurs within [30/60/90] days, the Client agrees to pay [e.g., 50% of the remaining balance].
● DJ Cancellation: In the unlikely event that the DJ must cancel, the DJ will [refund all payments or arrange a suitable replacement DJ, if available].
● Outdoor Events: Choosing to host an event outdoors are not without risk. Music equipment, photo-booths etc. costs thousands of dollars. 123 Events reserve the right to stop services if it is deemed that the weather will cause harm to the Dj or any equipment even under a tent electronics are not safe from rain.
● Force Majeure: Neither party shall be liable for any failure to perform due to causes beyond their control, such as natural disasters loss of power or government restrictions.
4. Event Requirements
The Client agrees to provide:
● Power Supply: Adequate power supply near the DJ setup area.
● Setup Area: A secure, sheltered area for DJ equipment.
The Client is responsible for ensuring a safe environment Access: Early access to the venue for setup at least [2 hours] before the event start time.
5. Music Selection and Requests
The DJ will work with the Client to create a playlist in line with the Client’s preferences. While requests will be taken during the event, the DJ has discretion to manage requests in a way that maintains event flow and vibe.
6. Liability
The DJ shall not be responsible for any injuries or property damage caused by attendees. The Client is responsible for ensuring a safe environment and will indemnify the DJ against any claims arising from the event.
●The Client is responsible for ensuring a safe environment for the Dj or team member to provide the agreed service. This includes harassment of 123 Events Atlanta Team Members as well as any damage to property by the clients guests.
7. Equipment Malfunctions
In the rare event of equipment malfunction, the DJ will make every effort to restore service promptly. The Client acknowledges that issues with equipment are beyond the DJ’s control, and no refunds will be issued unless a total performance failure occurs.
8. Media Release
The Client [grants/does not grant] permission for the DJ to use event photos, videos, or audio recordings for promotional purposes on the DJ’s website, social media, or marketing materials.
9. Agreement Modifications
Any modifications to this Agreement must be made in writing and agreed upon by both parties.
